The panel of witnesses included Sandra F. Braunstein, Federal Reserve Director of the Division of Consumer and Community Affairs, and Kenneth C. Montgomery, Federal Reserve Bank of Boston First Vice President and Chief Operating Officer. Committee Chairman Tim Johnson stated “Our jurisdiction extends over all financial services and payment systems regardless of the community that delivers the service. That’s why the committee needs to make sure there are no gaps in the rules, so that this emerging market is safe and efficient.”

“The Future of Money: How Mobile Payments Could Change Financial Services” held by the House Financial Institutions & Consumer Credit Subcommittee

Financial Services Chairman Bachus stated the hearing will examine the technology used to conduct mobile payments, identify potential security problems, and consider whether statutory changes are necessary as mobile payment systems become more widely available. In her opening statement, Subcommittee Chairwoman Capito said that she believes mobile payments should be as safe as cash, check, and credit card payments against hackers. Witnesses included representatives from the Federal Reserve Bank of Atlanta, PCI Security Standards Council, MasterCard Worldwide, Smart Card Alliance, and Consumers Union.

The panel of witnesses included Federal Trade Commission (FTC) Chairman Jon Leibowitz, newly confirmed FTC Commissioner Maureen Ohlhausen, and Department of Commerce General Counsel Cameron Kerry. Witness testimony is available here. The key take away from this hearing was the FTC’s position, supported by Chairman Rockefeller and Senator Kerry, that “Do Not Track” proposals must mean “Do Not Collect” which raises serious concerns for the future structure of e-commerce. Ranking Member Toomey raised serious and important questions regarding the need for any expansion of FTC authority and the real world impact of further regulation in this area.
